How Castillo’s Pharmacy protects your health information, and the rights you have over it.
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Effective date: October 5, 2026
This notice applies to Castillo’s Pharmacy, 1303 SE 47th Ter, Cape Coral, FL 33904, Florida pharmacy permit PH26062.
This notice covers this pharmacy only. Each of our pharmacies keeps its own patient records and its own Notice of Privacy Practices. We share your information with another of our pharmacies only where it is needed to serve you — to transfer a prescription at your request, or to have a compounded preparation prepared for you at our Brandon pharmacy. If you use more than one of our pharmacies, each holds its own records and each notice applies separately.
Our duties
We are required by law to keep your protected health information private, to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect. We are also required to notify you if a breach occurs that compromises the privacy or security of your information.
How we may use and share your health information without your authorization
For treatment
To dispense your prescriptions, check for interactions and counsel you, and to speak with your prescribers and other healthcare providers involved in your care. This also covers transferring a prescription to or from another pharmacy at your request, and sending a compounded preparation to be made for you at our Brandon pharmacy.
For payment
To bill and collect from you, your insurer or another payer — for example, submitting a claim to your prescription plan or obtaining prior authorization.
For health care operations
To run the pharmacy well: quality review, staff training and supervision, licensing and accreditation, business planning, and audits.
Other situations the law permits or requires
- As required by law, including reporting to the Florida Board of Pharmacy or the Prescription Drug Monitoring Program.
- Public health activities — adverse drug reactions, product recalls, immunizations and disease control.
- Health oversight — audits, inspections and investigations by agencies that oversee pharmacies.
- Abuse, neglect or domestic violence, where we are required or permitted to report it.
- Judicial and administrative proceedings, in response to a court order, subpoena or other lawful process.
- Law enforcement, in the limited circumstances the law allows.
- To avert a serious threat to the health or safety of you or others.
- Workers’ compensation, as authorized by law.
- Research, coroners, medical examiners, funeral directors and organ donation, where the law permits.
- Military, national security and correctional institutions, in the specific circumstances the law allows.
- To people involved in your care — a family member, friend or carer collecting a prescription for you — limited to information relevant to that involvement. You may ask us not to.
Uses that always need your written authorization
We will not do any of the following without your written authorization, which you may revoke at any time in writing:
- Sell your protected health information.
- Use or share it for marketing, other than limited face-to-face communication or a promotional gift of nominal value.
- Share psychotherapy notes, where we hold any.
- Most other uses not described in this notice.
If you revoke an authorization we will stop the use or sharing it covered, except where we have already acted in reliance on it.
Your rights
You have the rights set out below regarding the health information we hold about you. To exercise any of them, ask at the pharmacy counter, or contact the Privacy Officer using the details at the end of this notice. Most requests should be made in writing; staff will give you the form you need and can help you complete it. We will respond within 30 days.
To see and get a copy of your records
You may inspect and obtain a copy of your pharmacy records, electronically where we hold them electronically. We may charge a reasonable, cost-based fee. We will respond within 30 days.
To ask us to correct your records
If you believe information we hold is wrong or incomplete, you may ask us to amend it. We may deny the request and will explain why in writing; you may then file a statement of disagreement, which we will keep with your record.
To get a list of disclosures
You may request an accounting of certain disclosures made in the six years before your request. Disclosures for treatment, payment and operations, and those you authorized, are not included. One list in a 12-month period is free.
To ask for restrictions
You may ask us to limit how we use or share your information. We are not required to agree, except in one case: if you pay in full out of pocket for a prescription and ask us not to tell your health plan, we must agree.
To be contacted a particular way
You may ask us to contact you at a different address or phone number, or in a particular way. We will accommodate reasonable requests and will not ask you why.
To a paper copy of this notice
You may ask for a paper copy at any time, even if you agreed to receive it electronically. Ask at the pharmacy.
To be told about a breach
We will notify you if a breach occurs that compromises the privacy or security of your information.
To choose someone to act for you
If you have given someone medical power of attorney, or they are your legal guardian, they can exercise these rights for you. We will confirm their authority first.
Complaints
If you believe your privacy rights have been violated, please tell us — we would rather hear it and put it right. Contact our Privacy Officer using the details below.
You may also complain to the U.S. Department of Health and Human Services, Office for Civil Rights, at 200 Independence Avenue S.W., Washington, D.C. 20201, by calling 1-877-696-6775, or at hhs.gov/ocr/privacy/hipaa/complaints.
